Oppression & Mismanagement Matters
Service Overview
Service Overview
Oppression & Mismanagement Matters arise when the affairs of a company are conducted in a manner prejudicial to minority shareholders, oppressive to certain members, or detrimental to the company’s interests. Such cases typically involve abuse of majority control, diversion of funds, lack of transparency, exclusion from management, or actions contrary to corporate governance principles.
These proceedings are filed before the National Company Law Tribunal (NCLT) under the Companies Act, 2013. The Tribunal has the authority to pass orders regulating company affairs, restraining wrongful acts, directing share buyouts, or providing other equitable relief to protect stakeholder interests.
This service includes drafting and filing petitions, representation before NCLT, interim relief applications, negotiation support, and enforcement of tribunal orders.
The objective is to safeguard shareholder rights, restore fair corporate governance, and ensure lawful management of company affairs.
