DRAT Appeals are statutory remedies available against orders or judgments passed by the Debt Recovery Tribunal (DRT). Any aggrieved party, whether borrower or financial institution, may approach the Debt Recovery Appellate Tribunal (DRAT) seeking review, modification, or setting aside of the DRT order.
These appeals may arise in matters relating to loan recovery, SARFAESI proceedings, attachment of assets, possession notices, auction confirmation, interim relief orders, or procedural irregularities.
The appellate tribunal examines legal errors, jurisdictional defects, misinterpretation of law, and improper appreciation of facts by the DRT. Filing of an appeal is subject to prescribed limitation periods and statutory pre-deposit requirements.
This service includes drafting appeal memorandums, stay applications against recovery or auction proceedings, compliance with pre-deposit norms, and comprehensive representation before DRAT.
